Civil Process

A responsibility of the Civil Division is the service of Civil Process. Approximately 80,000 various civil papers are entered through the Civil Process unit. There are thirteen officers who handle the bulk of the civil process papers. 

Office Hours:  Monday - Friday   8:00am - 5:00pm

                           Service Fees:   $15 for in-state papers 
                                                       $50 for out-of-state papers

Payments accepted are:  Cash, Money Order or Cashier's Check.  NO PERSONAL CHECKS WILL BE ACCEPTED.  Checks should be made payable to the Office of the Sheriff of Durham County. 

Papers must be received within 10 working days prior to the court date.  We will except them in an emergency situation as long as they are received within 3 working days of the court date and upon approval of the Lieutenant.  Faxed copies are served only in case of an emergency.

All papers must be dated, signed, and have a file number listed.  Papers MUST list a physical address for the defendant. 

WE CANNOT SERVE A POST OFFICE BOX.
