Adult Day Care Services What is Adult Day Care? An organized program of services in a group setting.
Why Adult Day Care? To help older and disabled adults to be as independent and self-sufficient as possible.
To enable older and disabled adults to continue living in their own home or the home of relatives when possible, and to prevent or delay institutionalization. Day Care Services is for older or disabled adults who?

Need supervision or help in caring for themselves during the day so they can continue living in their own home or with relatives, |
 |
Need to be involved in social activities which are enriching and stimulating in order to continue in their present state of health, |
 |
Need assistance in moving from residential group care to independent living in their own community. |
Who can participate? Persons who meet the Division of Social Services eligibility and income requirements for the program.
The services may be provided free for persons with low incomes, or if their income is higher than the maximum allowed, they may be required to pay a fee for the services.

Adult Protective Services Adult Protective Services are services provided by the Department of Social Services to protect disabled adults from abuse, neglect, exploitation, whether they live independently, in a group facility (rest home, nursing home, etc.) or in an institution.
The Adult Protective Services Law authorizes the county Department of Social Services to evaluate reports of Abuse, Neglect, and Exploitation of Disabled Adults and to provide services by voluntary consent or court order to those Disabled Adults who are in need of protection.
The Disabled Adult in need of protective services might be your friend, neighbor or relative, it might even be you!

Who is a Disabled Adult? Any person 18 years of age or older (16-18 if lawfully emancipated minor) who is present in the state of N.C., and physically and/or mentally incapacitated due to:

Mental retardation, cerebral palsy, epilepsy or autism, or |
 |
Organic brain damage caused by advanced age or other physical degeneration in connection therewith; or |
 |
Conditions incurred at any age which are the result of accident, organic brain damage, mental or physical illness, or continued consumption or absorption of substances. |
What is Abuse, Neglect, and Exploitation? Abuse - The willful infliction of physical pain, injury or mental anguish, unreasonable confinement, or the willful deprivation of services by a caretaker, which are necessary to maintain the disabled adult's mental/physical health.
Neglect - The inability of a disabled adult to provide for himself the services which are necessary to maintain his mental/physical health, and he is not receiving services from his caretaker.
Exploitation - The improper use of a disabled adult, or his resources for another's profit or advantage.
How Can You Help? Telephone, write, or visit the Durham County Dept. of Social Services when you have information about a disabled adult being abused, neglected, or exploited. You should give the following information pertaining to the disabled adult.

Should You Give Your Name, Address, Phone Number? YES - The Dept. of Social Services might need additional information from you. The Dept. of Social Services would like to notify you of the results of the evaluation.
What Do You Receive? 1. The benefit of knowing that you assisted in the protection of a disabled adult from further abuse, neglect, exploitation, thereby enhancing his life.
2. Immunity from any civil or criminal liability unless you acted in bad faith or with a malicious purpose.
When is a Person Mentally Incapacitated? When he lacks sufficient understanding or the capacity to make or communicate responsible decisions concerning his person, including but not limited to provisions for health or mental health care, food, clothing, shelter?
What will the Department of Social Services Do? Upon receiving a report of abuse, neglect, exploitation of a disabled adult, the Dept. of Social Services will:

Make a prompt and thorough investigation within 72 hours (24 hours if the report describes an emergency). |

Visit the disabled adult as often as is necessary to determine if he is in need of protective services. |
| 3. |
Consult with others who have knowledge of the facts of the situation. |
| 4. |
Consult with medical, psychological and/or psychiatric professionals. |
| 5. |
Arrange for the provision of protective services when the disabled adult consents to the provision of such services. |
| 6. |
Obtain judicial authority to provide protective services when the disabled adult lacks the capacity to consent. |
| 7. |
Arrange for emergency services. |
| 8. |
Arrange for essential services (food, clothing, fuel, shelter) |
| 9. |
Mobilize the disabled adult's strengths, family strengths, and community resources to remedy abuse, neglect, exploitation. |
