Administers and enforces the sedimentation and erosion control sections 3.8, 12.10 and 15.5 of the Durham City/County Unified Development Ordinance  and the Durham County Stormwater Ordinance.  The Erosion Control jurisdiction includes all privately funded, non-agricultural land-disturbing activities of more than 12,000 square feet in both the City of Durham and the unincorporated areas of Durham County.  The Durham County Stormwater Ordinance (Chapter 14 Article V of the Durham County Ordinances) applies to all unincorporated areas of Durham County.

Jordan Lake Rules

During 2009, the North Carolina State Legislature adopted new legislation (S.L. 2009-216) in an effort to further protect the water quality of the B. Everett Jordan Reservoir (Jordan Lake) by creating a Nutrient Management Strategy (Jordan Rules. Jordan Lake is classified as a Nutrient Sensitive Water (NSW) and is also listed as impaired due to over-enrichment of nutrients (phosphorous and nitrogen). The intent of the rules is to restore and maintain water quality in the lake as a drinking water supply.

Durham County already implements various storm water programs within its jurisdiction. This includes water supply watershed protection, riparian buffer rules and Neuse NSW rules. The County’s water supply watershed protection and riparian buffer rules have long been implemented in portions of the Jordan Lake watershed. This Stage I Adaptive Management Program seeks to enhance Durham County’s existing rules.
