The Durham County Stormwater & Erosion Control Office issues permits for all land-disturbing activities within the City of Durham and Durham County. Office hours are Monday – Friday, 8:30 AM to 5:00 PM.

A. SITES LESS THAN 12,000 SQ./FT.
- No plan or permit required.
B. SITES GREATER THAN 12,000 SQ./FT. TO 1 ACRE
1. No plan required

C. SITES GREATER THAN 1 ACRE

D. SITES GREATER THAN 5 ACRES
1. All items from Section C plus performance security (Amount of security to be determine during plan review)
E. CUMULATIVE ACCOUNTING FOR SUBDIVISIONS
When multiple parties are conducting land-disturbing activities pursuant to a site plan, all of these land disturbing activities are aggregated and covered by both the UDO and the NPDES program. Both of these require aggregation of properties under diverse ownership which are developed as a unit, or pursuant to a “larger common plan of development.”
Within such a site, when an individual is conducting land-disturbing activity on two or more lots concurrently, the site acreage is the cumulative land-disturbing activity area for these properties within the subdivision. If the cumulative land-disturbing activities are greater than one (1) acre, than an erosion control plan is required. Durham County has a generic single family lot erosion control plan which may be used, “Single Family Erosion Control Options, May 3, 2006.” If the entity wishes to use alternative erosion control methods, the erosion plans must be pre-approved by Durham County Stormwater and Erosion Control. Also, NPDES General Permit NCG010000 applies to entities with cumulative land-disturbing activities greater than one (1) acre.
