The Board of Commissioners asks its members and citizens to conduct themselves in a respectful, courteous manner, both with the Board and fellow citizens.  At any time, should any member of the Board or any citizen fail to observe this public charge, the Chairman will ask the offending person to leave the meeting until that individual regains personal control.  Should decorum fail to be restored, the Chairman will recess the meeting until such time that a genuine commitment to the public charge is observed.

 

As a courtesy to others, please turn off cell phones during the meeting.

4.     Recognition of City of Medicine High School Awards

                                                                                                                                                             5 min.

The City of Medicine High School Awards is a program of the Greater Durham Chamber of Commerce and is sponsored by The Merck Foundation and Duke University Health System. This is the 10th year of awarding the program, which is designed to reward Durham students seeking to achieve a career in the healthcare industry.  The scholarships are awarded to seniors who have demonstrated high academic performance, participated in community service activities, and chosen to pursue a career in the field of medicine.

 

First Place Award winners, $3000 Scholarships:

County Manager’s Recommendation: The Manager recommends that the Commissioners extend congratulations to the 2005 City of Medicine Award Winners.

 

5.     May Anchor Award Winner—Benjamin Massey

                                                                                                                                                             5 min.

Deputy Benjamin Massey, Durham County Sheriff’s Office, was selected to receive the May Anchor Award.  Mr. Massey was recognized for this honor because of superior work, particularly for his performance during a house call to Inverness Drive in December 2004.

 

·   Deputy Massey went beyond the call of duty to check on the welfare of a citizen after receiving a telephone phone call from distant relatives.

 

·   Deputy Massey not only rescued the fallen victim, but also potentially saved a life.

 

Chairman Ellen Reckhow will lead the presentation. 

 

County Manager’s Recommendation: The Manager recommends that the May Anchor Award be presented to Deputy Benjamin Massey along with congratulations of the entire organization.

 

6.     Resolution Condemning Cross Burnings on May 25, 2005

                                                                                                                                                             5 min.

Durham County Government strongly condemns the cowardly acts of cross burnings that occurred in Durham on Wednesday, May 25, 2005.  A resolution has been prepared which calls upon the citizens of Durham to work towards peace and reconciliation among all races and further supports efforts to find the perpetrators and bring them to justice.

 

County Manager’s Recommendation: The County Manager recommends approval of the resolution as prepared by staff.

 

6a.   Resolution Regarding Increasing the State Cigarette Tax to Support County Medicaid Relief

                                                                                                                                                             5 min.

Medicaid relief is one of the North Carolina Association of County Commissioners priority legislative issues.  North Carolina is one of two states that require county governments to participate in all costs of Medicaid.  Recently, New York took action to lower the costs of Medicaid to its counties.

 

County Manager’s Recommendation: The Manager’s recommendation is that the Board approve the resolution and forward copies to General Assembly House Speaker James Black, Senate Pro Tempore Marc Basnight, and members of the Durham Delegation.

 

7.     Consent Agenda                                                                                                                           20 min.

 

a.       Budget Ordinance Amendment No. 05BCC000060—Board of Elections—
List Maintenance Grant (approve the North Carolina State Board of Elections grant totaling $11,278.00 for the mandated list maintenance process);

b.       Budget Ordinance Amendment No. 05BCC000061—Interest Earnings and Fund Balance Appropriation for Debt Service Fund Payments (appropriate $163,534 in interest earnings and $289,466 in General Fund fund balance with a transfer to the Debt Service Fund);

c.       Budget Amendment No. 05BCC000062 and Capital Project Amendment
No. 05CPA000013—ERP Project (DC082) (transfer $40,000 to the ERP Capital Project and authorize the Manager to sign the appropriate documents to increase the contract to a not-to-exceed amount of $2,587,993);

d.   Budget Ordinance Amendment No. 05BCC000063—Durham County Judicial Building “Smart" Security Revolving Door Installation (transfer $41,294 from the Commissioner’s Contingency funds to the Emergency Management budget; authorize the Manager to enter into a contract with D.W. Ward Construction in the amount of $103,904 for installation and authorize the County Manager to execute change orders, if necessary, not to exceed $10,390 (10%); the total contract shall not exceed $114,294);

e.   Budget Ordinance Amendment No. 05BCC000064 for Personnel Transition Costs in the Manager’s Office (transfer $38,428 from the Board of County Commissioners Contingency to the County Manager’s budget for unbudgeted transition costs);

f.    Budget Ordinance No. 05BCC000065—Sheriff’s Office Year-End Budget Adjustment (recognize the Sheriff’s Office revenue surplus and appropriate the funds as requested to offset the anticipated salary deficit);

g.   Budget Amendment No. 05BCC000066 and Capital Project Amendment
No. 05CPA000014 New Hope/Duke University Land Acquisition (appropriate $275,000 of General Fund funds for the initial phase of the Duke University land acquisition and allocate $500,000 for the initial phase of the Duke University acquisition on New Hope Creek);

h.   Reimbursement Resolution Related to Erwin Trace Property Acquisition (adopt the Resolution establishing the Board’s intent to reimburse the County from the proceeds of one or more issues of $12,230,000 general obligation bonds to be authorized in 2006 for expenditures paid not earlier than April 14, 2005 with respect to expenditures in connection with the acquisition of the Erwin Trace);

i.    Capital Project Ordinance Amendment No. 05CPA000012—Land Acquisition for the New Justice Center Project (approve in the amount of $2,063,818 for land acquisition for the new Justice Center Project);

j.    Durham’s Home and Community Care Block Grant Funding Plan through the Department of Social Services (approve as presented;  funding for the Plan has been incorporated into the Manager’s proposed FY 2006 Budget.);

k.   Award of Contract for Inmate Meal Preparation & Food Services (RFP #05-021) (award the contract to the lowest responsive bidder, Aramark Correctional Services; the initial term of the contract would be July 1, 2005 through June 30, 2008, with the option to renew by the County for two successive one-year periods under the same terms and conditions);

l.    Award of Contracts for Fleet Maintenance and Repair Services (RFP# 05-001R) (authorize the County Manager to execute two requirement contracts on an as needed basis with Auto World Service Center and Speights Auto Center; the terms of the contract would be for three years with the option to extend for 2 additional two-year periods; price adjustments will be agreed upon prior to the beginning of each fiscal year);

m.    Community Health Trust Fund Policy (approve the request and authorize the transfer of funds);

 n.    Reorganize Existing Durham County EMS Advisory Council (approve the changes to the EMS Council structure as recommended by the Council and direct the Clerk to the Board to advertise to fill the existing vacancies);

 o.    Document Management/Imaging Vendor Contract (approve the contract award to OneSource and authorize the Manager to execute the required contract documents);

 p.    Emergency Electrical Power System and Moisture Remediation at the Durham County Animal Shelter (authorize the Manager to enter into two separate contracts; one contract for Bryant-Durham Services Inc. to supply and install an electric power system for $73,890 and to execute change orders, if necessary not to exceed $7,389 (10%), for a total of $81,279.  Authorize the Manager to enter into a second contract for Patriot Building Company Inc. for moisture remediation in the amount of $17,950 to execute change orders if necessary, not to exceed $1,790 (10%), for a total of $19,745.); and

q.     Execution of Consultant Agreement with Trigon Engineering Consultants Inc. for the Comprehensive Site Assessment at the proposed Durham County Justice Center Site (authorize contract execution to provide professional services for the Comprehensive Site Assessment and Corrective Action Plan, if required, in the amount of $55,556.00, plus a reimbursable amount of $2,800.00 for a total of $58,356.00).

 


8.     Public Hearing on the 2005-06 Recommended Budget

                                                                                                                                                            60 min.

The Board of County Commissioners will conduct a public hearing to receive citizen input on the FY 2005-2006 recommended budget.  To be able to hear from all interested citizens, the Commissioners usually set a time limit of three minutes for each speaker; however, the time limit may be adjusted at the discretion of Chairman Reckhow.

 

County Manager’s Recommendation: The Manager recommends that the Board receive input from speakers and incorporate in the deliberations prior to finalization of next fiscal year’s budget.

9.     Appointments to the Durham-Wake Research and Production Service District

                                                                                                                                                            10 min.

The Commissioners are requested to vote on appointments to the Durham-Wake Counties Research and Production Service District.

 

County Manager’s Recommendation: The Manager recommends that the Board of County Commissioners vote to appoint members to the district.
